The Virginia five (5) day notice to pay or quit is used when a tenant has failed to pay rent. The landlord must serve a written notice on the tenant and allow them five (5) days to pay the full past-due amount before filing an eviction lawsuit against them. If the tenant does not pay the rent or move out of the rental unit by the end of the notice period, the landlord can sue them for possession of the property. In the event that the tenant pays the past-due amount on time, they can continue their tenancy and the landlord cannot file an eviction suit against them.
