The West Virginia notice to quit is a form that is given to a tenant from the landlord when the tenant has broken their lease agreement or failed to pay their rent on time. There is no law in the State that requires the landlord to give the tenant notice before filing an eviction action if the tenant hasn’t paid rent or has committed a lease violation/illegal activity. Therefore, the notice is issued only at the landlord’s discretion and it is up to the landlord if they will give the tenant the opportunity to retain their lease by paying the full amount owed or fixing their lease violation.
