The Massachusetts thirty (30) day notice to quit is an eviction letter used by a landlord or tenant to terminate a month-to-month rental agreement. Either party may terminate the tenancy by serving the notice to quit in advance; for month-to-month tenancies, the notice must be served at least thirty (30) days or one (1) rental period in advance, whichever is longer (the rental period is the interval between rent payments). If payments are made at periods of three (3) months or longer, the notice to quit must be served three (3) months in advance. The tenant, upon receiving or serving the notice, will be required to vacate the premises within the designated notice period. Should they fail to move out after their tenancy expires, the landlord may commence the eviction process by filing a Summons and Complaint with the court.
Note: This eviction notice may be used to terminate month-to-month tenancies without cause.
