The North Carolina seven (7) day notice to quit is used by a landlord to inform a month-to-month tenant of their intention to terminate the lease or rental agreement. State law requires that a tenant must receive seven (7) days notice to vacate before a monthly tenancy is terminated. No reasoning must be provided to terminate a month-to-month tenancy, but the termination cannot be in discrimination or retaliation towards the tenant. If the tenant does not vacate the premises by the end of the seventh (7th) day, the landlord can file a “Complaint in Summary Ejectment” in court to sue the tenant for possession of the property.
