South Dakota 3 Day Notice to Pay or Quit

The South Dakota three (3) day notice to pay or quit is to be used by a landlord when evicting a tenant for the non-payment of rent. The written notice informs the individual that they must pay the total amount due AND vacate the premises within three (3) days of receiving the notice. While not required, the landlord may allow the tenant to continue their tenancy upon payment of the rent within the notice period. The notice to pay or quit also states that, upon failure of the tenant to pay the rent and vacate within three (3) days, the landlord shall be permitted to institute legal proceedings against the tenant to remove them from the premises.

Note: The South Dakota three (3) day notice to pay or quit may only be served on a tenant when the rent payment is three (3) days late.
