South Dakota 3 Day Notice to Quit | Holding Over

The South Dakota three (3) day notice to quit is a document informing a tenant that their tenancy has expired or has been terminated, and that they must vacate the premises within three (3) days. The notice to quit is reserved for use on tenants holding over (tenants occupying the premises without the consent of the landlord). The landlord must serve the notice on the tenant before the three (3) day period becomes effective. If the tenant continues to inhabit the dwelling after the three (3) day notice period expires, the landlord may seek to evict the individual by filing a Forcible Entry and Detainer action with the court.
