The Minnesota notice to quit is used by a landlord or tenant to terminate an “at will” rental agreement (tenancy with no specific end date, usually month-to-month). The notifying party must provide a notice period as long as either the amount of time between rental payments or three (3) months, whichever is shorter. It will then be the tenant’s responsibility to vacate the premises within the specified timeframe. If the tenant continues to reside on the premises past the expiration of the notice period, the landlord can file an eviction complaint, a.k.a. “Unlawful Detainer,” with the circuit court.
